Welcome to Tovi
These terms apply when you use the Tovi app, website, routes, media, and related services. By using Tovi, you agree to them. If you do not agree, do not use the service.
Who may use Tovi
You must be at least 13 years old to use Tovi. If you are under the age of legal majority where you live, a parent or guardian must review these terms and permit your use. Do not use Tovi where doing so would be unlawful.
What Tovi provides
Tovi offers short interactive walks with Mochi, route and music content, optional reminders, a walking profile, synced progress, and a leaderboard. Features may change as Tovi develops, especially during private beta.
Tovi grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use the service for your own non-commercial enjoyment in accordance with these terms.
Walk safely
Tovi is a wellbeing companion, not medical, fitness, rehabilitation, or emergency advice.
Pay attention to your surroundings, traffic, weather, terrain, and other people. Do not look at or handle your device when it would be unsafe.
Choose movement appropriate for your health and ability. Stop if you feel pain, dizziness, distress, or danger, and seek qualified help when needed.
Routes shown in Tovi are media experiences and do not represent your real-time location or guarantee that a physical path is safe or accessible.
Your walking profile and Passkey
Tovi creates an anonymous walking profile so you can begin without registering an email or password. You are responsible for access to your device and any Passkey you connect. A Passkey may restore or merge walking data across devices, so approve only prompts you recognise.
Keep your walking name appropriate. Do not impersonate another person or use a name, photo, or other material that violates someone else’s rights.
Your photo and profile content
You keep ownership of a photo or name you provide. You give Tovi a limited licence to host, process, resize, display, and transmit that content only as needed to operate your profile, sync, and leaderboard. This licence ends when the content and related backups are deleted, subject to reasonable technical and legal retention.
Because profile names and avatars or photos may appear on the leaderboard, only upload content you are comfortable sharing with other Tovi users.
Fair use of the service
Do not interfere with Tovi, its APIs, hosting, security controls, or other walkers’ use.
Do not submit malicious code, automate abusive requests, manipulate walk credit, scrape personal information, or attempt unauthorised access.
Do not copy, resell, redistribute, or commercially exploit Tovi or its content except where law expressly permits it.
Do not use Tovi to violate law, intellectual-property rights, privacy, publicity, or safety.
Tovi’s content
Tovi, Mochi, the hand-drawn artwork, interface, software, text, route presentation, and other original materials are owned by or licensed to Tovi’s developer. Music, recordings, and other third-party materials remain subject to their respective rights. These terms do not transfer ownership to you.
Availability and changes
Tovi may add, remove, pause, or change features, routes, music, and beta access. We may suspend access where reasonably necessary for security, maintenance, legal compliance, misuse, or protection of the service. We will try to avoid unnecessary interruption, but uninterrupted availability is not guaranteed.
Disclaimers and responsibility
Tovi is provided on an “as available” basis. To the maximum extent permitted by law, we do not make promises about uninterrupted operation, particular health outcomes, route availability, or error-free content.
To the maximum extent permitted by law, Tovi’s developer is not liable for indirect, incidental, special, or consequential loss arising from use of the service. Nothing in these terms excludes rights or remedies that cannot legally be excluded, including applicable rights under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986.
Ending use
You may stop using Tovi at any time. Deleting the app does not automatically remove synced profile information; follow the deletion process described in the Privacy Statement if you want that information removed. We may end or restrict access for serious or repeated breach of these terms, unlawful conduct, or risk to the service or others.
Governing law and changes
These terms are governed by the laws of New Zealand, without limiting consumer protections that apply to you where you live. If part of these terms is unenforceable, the remaining terms continue.
We may update these terms as Tovi changes. The effective date above will change, and material changes will be communicated through the app or distribution channel when appropriate. Continuing to use Tovi after updated terms take effect means you accept them.
